Terms of Service

By accessing the Softcr8ors website or engaging us for any digital agency services, you agree to comply with and be legally bound by these Terms of Service. If you do not agree to these terms, you may not use our website or services.

These terms serve as the master agreement governing all business relationships between Softcr8ors and our clients, unless superseded by a specific, mutually signed Statement of Work (SOW) or Non-Disclosure Agreement (NDA).

Softcr8ors operates as a full-cycle digital innovation agency. We provide a range of specialized services including:

• Web Engineering & Custom Software: Next.js applications, complex dashboards, and scalable SaaS platforms.
• Mobile Innovation: Cross-platform (React Native) and native mobile application development.
• Branding & UI/UX Design: Corporate identity, logo design, user research, wireframing, and interactive prototyping.
• AI-Powered Apps: Integration of Large Language Models (LLMs), AI automation, and AI content generation tools.
• Video Production & SEO: High-end promotional videos, animated explainers, and search engine optimization services.

All project timelines provided during the proposal phase are estimates based on our extensive experience in software development and design. We utilize agile methodologies to ensure transparent and iterative delivery.

Delays may occur if there are unforeseen technical challenges, scope creep, or delays in receiving necessary assets, feedback, or approvals from the client. Any significant changes to the project scope will require a revised timeline and potentially additional costs via a Change Request.

Client Ownership: Upon receipt of full and final payment, all intellectual property rights to the finalized custom deliverables (e.g., custom source code, final logo designs, completed videos) are officially transferred to the client.

Agency Rights: Softcr8ors retains the rights to pre-existing code libraries, open-source tools, and generic frameworks used to build the software. Furthermore, we reserve the right to showcase the completed project in our portfolio, case studies, and marketing materials to demonstrate our expertise, unless explicitly prohibited by a signed NDA.

Our payment structure is designed to facilitate smooth project progression:

• An upfront deposit (typically 30% to 50%) is strictly required before any engineering or design work commences.
• Subsequent payments are tied to clear project milestones defined in the SOW.
• The final balance must be cleared before the project is deployed to a live production environment or final source files are handed over.

Softcr8ors reserves the right to suspend development, hosting, or consulting services if invoices are not paid within 14 days of the due date.

While we strive to write flawless, bug-free code and design perfect user experiences, software development is complex. In no event shall Softcr8ors, its founders, engineers, or designers be liable for any indirect, incidental, or consequential damages (including loss of profits, data, or business interruption) arising from the use of our software or services.

Our maximum aggregate liability for any claim related to our services shall not exceed the total amount paid by the client for the specific project milestone in question.

These Terms of Service shall be governed by and construed in accordance with the laws of Pakistan. Any legal disputes arising out of or related to these terms shall be resolved exclusively in the competent courts located in Lahore, Pakistan.
